What is Renunciation of Vietnamese Citizenship?

Obtaining Vietnamese citizenship refers to the process where a foreign national or stateless person applies to acquire Vietnamese citizenship. On the contrary, renunciation of Vietnamese citizenship is when a Vietnamese citizen applies to relinquish their Vietnamese citizenship in order to acquire the citizenship of another country. The reasons for renouncing Vietnamese citizenship may include:

  • Marriage or living abroad with a foreign national;
  • Studying or settling abroad;
  • Long-term employment or stable work abroad.

Renunciation of citizenship is a right recognized by law. Citizens who meet the necessary conditions will be considered for renunciation of Vietnamese citizenship in order to obtain the citizenship of another country.

Renounce Vietnamese Nationality

Conditions for Renunciation of Vietnamese Citizenship

According to the law, Vietnamese citizens who submit an application to renounce Vietnamese citizenship in order to acquire foreign citizenship may be considered. However, a citizen will not be allowed to renounce Vietnamese citizenship if they fall into one of the following categories:

  • Owing taxes to the State or having financial obligations to any organizations, agencies, or individuals in Vietnam;
  • Under criminal investigation;
  • Serving a sentence or complying with a court decision in Vietnam;
  • In temporary detention awaiting execution of a sentence;
  • Undergoing administrative measures in a reformatory, medical treatment center, or juvenile detention center.

*Note:

  • A person applying for renunciation of Vietnamese citizenship will not be allowed to renounce it if doing so would harm the national interests of Vietnam;
  • Officials, civil servants, and those serving in the People’s Armed Forces of Vietnam are not permitted to renounce Vietnamese citizenship.

Legal Consequences of Renouncing Vietnamese Citizenship

Individuals applying to renounce Vietnamese citizenship must submit their application to the competent state authority for consideration. Once the decision to approve the renunciation of Vietnamese citizenship is granted, the individual will no longer hold Vietnamese citizenship. The lack of Vietnamese citizenship will lead to the following legal consequences:

  • No protection of legitimate rights and interests by the Socialist Republic of Vietnam while abroad.
  • Restrictions on the rights to use and own real estate in Vietnam.
  • Limitations on travel and residence in Vietnam.
  • Minor children of individuals who renounce Vietnamese citizenship will also change according to their parents’ nationality.

Those who have renounced Vietnamese citizenship may only regain it if they are not eligible for foreign citizenship. In such cases, the individual seeking to return to Vietnamese citizenship must go through the application process. A request to regain Vietnamese citizenship may be denied if it is deemed detrimental to the national interests of Vietnam.

Application Documents for Renouncing Vietnamese Citizenship

The application for renouncing Vietnamese citizenship includes:

  • Application form for renouncing Vietnamese citizenship.
  • Personal history statement.
  • A copy of the Vietnamese passport, ID card, or other identification documents.
  • Criminal record certificate issued by the competent authority of Vietnam. This certificate must be issued within 90 days prior to the submission of the application.
  • Documentation confirming that the individual is in the process of applying for foreign citizenship, unless the foreign law does not require such documentation.
  • A certificate of tax clearance issued by the tax authority in the area where the applicant resides.
  • For individuals who were previously officials, public servants, or served in the Vietnamese armed forces and have retired, resigned, been dismissed, or discharged within the last 5 years, a document from the authority, organization, or unit that issued the retirement, resignation, dismissal, or discharge decision confirming that the renunciation of Vietnamese citizenship does not harm the national interests of Vietnam.

In the case of Vietnamese citizens residing abroad, they are not required to submit documents 4, 6, and 7.

Procedure and Steps for Implementation

The agency responsible for receiving the application is the Department of Justice or the Vietnamese representative office abroad. After receiving the application, the Department of Justice or the representative office will contact other competent state authorities to process the application. If the application is valid and processed correctly, it will be submitted to the President of the Republic for consideration. The President has the authority to decide whether to grant the request.
