This issue is regulated under Clause 1, Article 127 of the 2014 Marriage and Family Law:
“Article 127. Divorce with Foreign Elements
- Divorce between a Vietnamese citizen and a foreigner, or between foreigners residing in Vietnam, shall be resolved by the competent authorities in Vietnam in accordance with the provisions of this Law.”

Hello, sir. Currently, divorce fees in Vietnam are divided into two categories: fees with a fixed value and fees without a fixed value. We would like to clarify as follows:
Fees with a fixed value:
This applies in cases where the court is only requested to terminate the marriage, without any request for asset division or debt allocation.
Fee: 300,000 VND.
Fees without a fixed value:
This applies in cases where the court is requested to divide joint assets or debts between the spouses. The fee is calculated based on the value of the assets as follows:
- Assets under 6,000,000 VND: 300,000 VND.
- Assets from 6,000,000 VND to 400,000,000 VND: 5% of the disputed asset value.
- Assets from 400,000,000 VND to 800,000,000 VND: 20,000,000 VND + 4% of the amount exceeding 400,000,000 VND.
- Assets from 800,000,000 VND to 2,000,000,000 VND: 36,000,000 VND + 3% of the amount exceeding 800,000,000 VND.
- Assets from 2,000,000,000 VND to 4,000,000,000 VND: 72,000,000 VND + 2% of the amount exceeding 2,000,000,000 VND.

” 3.The court must send a notice of acceptance of the civil case, which specifies the time and place for the session, as well as the resumption of the session to resolve the civil case, in the written notice to the parties involved abroad.
The session must be held no earlier than 6 months and no later than 8 months from the date of the notice of acceptance of the civil case. The date for resuming the session (if any) is set no later than 1 month after the first session.”
