Who is responsible for paying divorce fees in Vietnam – the wife or the husband?

In Vietnam, the person responsible for paying divorce fees depends on the type of divorce and the agreement between both parties.

  • Mutual Consent Divorce: In the case where both spouses agree to divorce (mutual consent divorce), they can mutually decide who will bear the divorce fees or split the costs equally. Usually, this is arranged by the parties themselves. If no agreement is made, the fees are typically split equally between both parties.
  • Unilateral Divorce: In the case of unilateral divorce (one party files for divorce), the party submitting the divorce petition is responsible for the initial court fees. How to Calculate Divorce Court Fees in Vietnam

The calculation of divorce court fees in Vietnam is specifically regulated under Resolution No. 326/2016/UBTVQH14 of the Standing Committee of the National Assembly, applicable to both unilateral and mutual divorces. Below is a detailed guide on how these fees are calculated:

Divorce court fees without asset disputes:

If the divorce case involves no disputes over assets (including both mutual and unilateral divorces), the fixed first-instance court fee is 300,000 VND.

Divorce court fees with asset disputes:

If the divorce case involves asset disputes and requires court resolution, the court fees are calculated based on the value of the disputed assets as follows:
