Procedures for Recognition of Arbitration Awards in Vietnam

Conditions for Recognition:

  • Domestic Arbitration Awards: The award must be issued by a legally established arbitration center in Vietnam, based on a valid arbitration agreement between the parties.
  • Foreign Arbitration Awards: The award must be issued by arbitration in a country that is a member of the 1958 New York Convention and must not violate Vietnam’s public policy

Required Documentation for Recognition:

Applicants seeking recognition and enforcement of an arbitration award must prepare the following:

  • An application for recognition and enforcement of the arbitration award (as per the prescribed form).
  • A certified copy of the arbitration award (with a notarized Vietnamese translation for foreign awards).
  • A copy of the arbitration agreement between the parties.
  • Other relevant documents or evidence to support the recognition request.
  • For foreign arbitration awards, a certificate of legality from the issuing country’s competent authority may be required.

Steps for Recognizing Foreign Arbitration Awards Under Vietnam’s Civil Procedure Code:

Step 1: Submit the Application

The applicant must file a request in accordance with Article 425 of the Civil Procedure Code. The form and content of the application must comply with Article 452 of the Civil Procedure Code.

Step 2: Application Processing

The competent court will process the application. Within 3 working days from receiving the application, the Chief Justice will assign a judge to handle the request.

Step 3: File Acceptance

Within 5 working days of receiving the dossier transferred by the Ministry of Justice, the competent court will review, accept, and notify the parties involved, including the party obligated to enforce the award, their legal representatives in Vietnam, the People’s Procuracy, and the Ministry of Justice.

Step 4: Preparation for Reviewing the Application

The court must prepare to review the application within 2 months of acceptance. During this period, the court may request clarification from the party seeking enforcement. If needed, this preparation period can be extended by up to 2 months.

Step 5: Conducting the Review Session

The application is reviewed in a hearing conducted by a panel of three judges, with one acting as the chair. The panel cannot re-examine the merits of the dispute already decided by the foreign arbitration.

Step 6: Issuance of Decision

After considering the application, documents, and arguments presented during the hearing, the panel will decide by majority vote. A decision will be issued to either recognize or refuse recognition of the foreign arbitration award.
