What is acquiring Vietnamese citizenship?

Citizenship is the basis for determining the rights and obligations of citizens with the country of their nationality. Vietnamese citizenship reflects the relationship between Vietnamese citizens and the Socialist Republic of Vietnam. A person with Vietnamese citizenship is a Vietnamese citizen, guaranteed civil rights, and must fulfill civic duties to the State according to the law.

Acquiring Vietnamese citizenship can be understood as a foreign national or a stateless person applying to become a Vietnamese citizen. To determine if a person has Vietnamese citizenship, the following bases are used:

• Being born and abandoned, found within the territory of Vietnam.

Conditions for acquiring Vietnamese citizenship

To acquire Vietnamese citizenship, the following conditions must be met:

• Having full civil act capacity as prescribed by Vietnamese law.
• Complying with the Constitution and laws of Vietnam; respecting the traditions, customs, and practices of the Vietnamese people.
• Being proficient in Vietnamese to integrate into the Vietnamese community. This condition is assessed based on the ability to communicate in Vietnamese with Vietnamese citizens in daily life, suitable to the living and working environment.
• Having resided in Vietnam for 5 years or more up to the time of applying for Vietnamese citizenship. The basis for calculating the residency period is having been granted a permanent residence card in Vietnam.

There are some special cases where individuals may still be considered for citizenship even if they do not fully meet the above conditions:

• Being the spouse, biological parent, or biological child of a Vietnamese citizen.
• Having made special contributions to the cause of building and defending the Vietnamese Fatherland.
• Being beneficial to the State of the Socialist Republic of Vietnam.

It should be noted that those who acquire Vietnamese citizenship must renounce their foreign nationality, except for some special cases. Applicants for Vietnamese citizenship must have a Vietnamese name. This name is chosen by the applicant and is clearly stated in the Decision on Granting Vietnamese Citizenship.

What documents are needed for the citizenship application?

To complete the application for Vietnamese citizenship, the applicant needs to prepare the following documents:

• Application for Vietnamese citizenship.
• A copy of the birth certificate, passport, or other valid substitutes.
• A detailed personal background declaration.
• Criminal record certificates issued by the competent authority of Vietnam for the period of the applicant’s residence in Vietnam, and criminal record certificates issued by the competent authority of the foreign country for the period of the applicant’s residence abroad. The criminal record certificates must have been issued no more than 90 days prior to the date of application submission.
• Documents proving proficiency in Vietnamese.
• Documents proving the place of residence and duration of permanent residence in Vietnam.
• Documents proving sufficient financial means to ensure life in Vietnam.

Individuals exempted from certain conditions for acquiring Vietnamese citizenship will be exempted from the corresponding documents related to the waived conditions. Applicants for Vietnamese citizenship are not allowed to acquire Vietnamese citizenship if it harms the national interests of Vietnam.
